Candidate Terms & Consent

These terms explain how Berih may use a candidate's application information, conduct screening, make introductions, and communicate about potential opportunities.

Please read this document before submitting the applicable form. Electronic acceptance records your name, email address, date and time, IP address, and device information, and a signed copy is provided for your records.

Parties

This agreement is between Berih Workforce Solutions ('Berih', 'we', 'us', or 'our'), a staffing and recruitment business based in Calgary, Alberta, and the individual or organization electronically accepting it ('you' or 'your').

Electronic Signature

By ticking the acceptance box and submitting the applicable form, you consent to use an electronic signature and electronic records under Alberta's Electronic Transactions Act. You intend your electronic acceptance to be legally binding to the same extent as a handwritten signature. Berih records the accepted document version, your name, email address, date and time, IP address, and device or browser information and provides a copy for your records.

Accuracy of Information

You confirm that information and documents you provide are complete, current, and accurate to the best of your knowledge. You will promptly correct material changes. Berih may stop providing services, withdraw an introduction, or end your participation in a recruitment process if information is materially false, misleading, incomplete, or cannot reasonably be verified.

Privacy

Berih collects, uses, discloses, protects, and retains personal information as described in its Privacy Policy at berihworkforce.com/trust and under applicable privacy law, including Alberta's Personal Information Protection Act where applicable. You may ask about access, correction, withdrawal of consent, or deletion by writing to Info@berihworkforce.com. Some records may be retained where reasonably required by law, to document consent, resolve a dispute, prevent fraud, or establish and defend legal claims.

Eligibility and Right to Work

You confirm that you are legally entitled to work in Canada for any role for which Berih presents you and that you will disclose any permit expiry date, work restriction, licensing condition, or other limitation relevant to the role. You authorize Berih or the prospective employer to inspect reasonable supporting documentation. Providing an application does not create an employment relationship with Berih.

Recruitment and Representation Consent

You authorize Berih to assess your experience, contact you about potential opportunities, and represent or introduce you to prospective employers for recruitment purposes. Berih will normally discuss a specific opportunity with you before sending identifying application materials. You will tell Berih if an employer has already received your application for the same role or if another recruiter is representing you, so duplicate submissions can be avoided.

Disclosure to Prospective Employers

You authorize Berih to disclose your resume, contact details, qualifications, credentials, availability, screening results, interview notes, and other relevant application information to prospective employers and service providers involved in recruitment, verification, secure storage, or communications. Berih will limit disclosure to information reasonably connected to recruitment, placement, compliance, or the administration of an agreed assignment.

Credentials, Screening, and Verification

You authorize Berih to verify education, trade tickets, professional registrations, licences, safety certificates, driver records, employment history, and other role-related qualifications with issuing bodies or other appropriate sources. Criminal record, vulnerable sector, medical, drug and alcohol, credit, or other sensitive checks will only be requested where lawful, relevant to the role, and supported by any additional consent required. A successful check does not guarantee presentation or placement.

References

You confirm that you have permission to provide each referee's contact details and authorize Berih to contact those referees about your employment, duties, performance, reliability, conduct, and suitability for relevant work. You authorize the referee to provide that information. Berih may summarize relevant reference information for a prospective employer where lawful and appropriate.

Communications

You consent to receive recruitment-related calls, emails, and text messages at the contact details you provide. These may include application updates, interview arrangements, document requests, and suitable opportunity notices. Message and data rates may apply. You may ask Berih to stop optional opportunity notices, but Berih may still send messages necessary to administer an active application, placement, legal obligation, or consent record.

Interviews, Offers, and Employment Relationship

You will communicate honestly and professionally, attend agreed interviews or provide reasonable notice if unavailable, and promptly disclose changes to your availability or qualifications. A prospective employer makes its own hiring decision. Unless a later written agreement expressly states otherwise, an offer, employment contract, assignment, supervision, workplace policies, and termination are matters between you and the hiring employer, not Berih.

Temporary or Contract Assignments

If an opportunity involves temporary or contract staffing, Berih will identify the employing or payroll entity and provide applicable assignment terms before work begins. Those separate terms will address compensation, deductions, time reporting, overtime, vacation pay, statutory holiday pay, benefits if any, workplace coverage, assignment duration, and termination. You must not begin work until the responsible entity and assignment terms are confirmed in writing.

Pay, Hours, and Benefits

Pay rate, payroll frequency, schedule, overtime eligibility, expenses, benefits, and other working conditions vary by employer, assignment, and employment arrangement. No website content, recruiter discussion, or application creates a promise of specific pay, hours, benefits, duration, or reimbursement unless included in a written offer or assignment agreement issued by the responsible employer or payroll entity.

Candidate Conduct and Safety

You agree to follow lawful workplace rules, safety requirements, confidentiality obligations, and professional standards that apply to any interview, site visit, or assignment. You will report hazards, incidents, injuries, licence restrictions, and material fitness-for-duty concerns through the process identified by the employer or responsible staffing entity. You must not disclose a prospective employer's confidential information or use it for an unrelated purpose.

No Candidate Fees

Berih does not charge candidates a registration, application, referral, or placement fee. You remain responsible for personal costs such as optional training, document replacement, travel, licensing, or checks unless Berih or an employer agrees otherwise in writing. Tell Berih immediately if anyone claims to collect a placement fee on its behalf.

Withdrawal of Consent

You may withdraw from a recruitment process or withdraw consent to future representation by emailing Info@berihworkforce.com. Withdrawal does not invalidate lawful use or disclosure that occurred before Berih received it and may prevent Berih from continuing to consider you. Berih may retain a limited suppression record so your withdrawal is respected and records otherwise required by law or legitimate legal purposes.

No Guarantee of Placement

Berih does not guarantee an interview, offer, placement, specific wage, schedule, hours, benefits, assignment length, or continued engagement. Employers control their selection decisions and may change or cancel requirements. Berih may decide not to present an application where qualifications, availability, verification, client requirements, or suitability do not align.

Limitation and Mandatory Rights

Berih is not responsible for an employer's independent hiring decision, workplace conduct, changed requirements, or withdrawal of an opportunity. To the extent permitted by law, Berih is not liable for indirect, special, incidental, or consequential loss arising from a recruitment process. Nothing in these terms excludes a right or remedy that applicable employment, human rights, privacy, consumer protection, or other law does not permit the parties to exclude.

Entire Consent, Changes, and Severability

These Candidate Terms & Consent, the Privacy Policy, and any later written offer or assignment agreement are the relevant agreements for their respective subject matter. Berih may update these terms for future applications, but the version you accepted governs that submission unless a change is required by law and communicated to you. If a provision is unenforceable, it will be limited or severed and the remaining provisions continue.

Governing Law

This agreement is governed by the laws of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict-of-law rules. Subject to any right that cannot legally be waived, the courts of Alberta have exclusive jurisdiction over disputes arising from this agreement.
